Crowdcallr (hereinafter referred to as “CC”) is a non-profit research project which takes the form of an online Question and Answer (Q&A) platform. The CC website allows users to register accounts and interact with one another by asking and answering questions.
II. User Guidelines
Don’t break the law. Don’t take any action that infringes or violates other people’s rights, violates the law, or breaches any contract or legal duty you have toward anyone.
Don’t lie to people. Don’t post information you know is false, misleading, or inaccurate. Don’t do anything deceptive or fraudulent.
Don’t offer prohibited items. Don’t offer any rewards that are illegal, violate any of CC policies, rules, or guidelines, or violate any applicable law, statute, ordinance, or regulation.
Don’t victimise anyone. Don’t do anything threatening, abusive, harassing, defamatory, libelous, tortious, obscene, profane, or invasive of another person’s privacy.
Don’t spam. Don’t distribute unsolicited or unauthorised advertising or promotional material, or any junk mail, spam, or chain letters. Don’t run mail lists, listservs, or any kind of auto-responder or spam on or through the Site.
Don’t harm anyone’s computer. Don’t distribute software viruses, or anything else (code, films, programs) designed to interfere with the proper function of any software, hardware, or equipment on the Site (whether it belongs to CC or another party).
Don’t abuse other users’ personal information. When you use CC you may receive information about other users, including things like their names and email addresses. This information is provided for the purpose of participating on the CC platform: don’t use it for other purposes, and don’t abuse it.
III. The Service
By visiting, perusing and interacting with CC’s Website (crowdcallr.org), its users, and/or any other aspect of its service, the user agrees to the following terms and conditions:
This Site provides a service via an online-platform whereby entities facing research bottlenecks (known as “Seekers“), may post their research problems or questions to the Site, wherein entities keen to try and solve any of the said problems (known as “Solvers”) may post suggested solutions to problems. By using this Site, you agree that CC is a neutral forum. You also agree to follow the Site guidelines at all times. CC is for your personal, academic and non-commercial use only.
The Site is not available for use by minors (those under 18 years of age, or otherwise under applicable law). If you do not qualify, please do not use the Site.
To be eligible to solve CC problems, you must register as a user. You may cancel your registration at any time by contacting email@example.com As part of the registration process, you will be asked to provide your name, email address, select a password and login name. We also ask for you to provide the name of the research institution that you are primarily affiliated with, so that we can assess the usage of the site by institution.
You may not use a login name of another Solver. You may not disclose or share your password to any third parties or use your password for any unauthorised purposes. You agree to notify CC at any unauthorised use of your account or breach of security, including loss, theft, or unauthorised disclosure of your password or login information. Remember, you are responsible for maintaining the confidentiality of your password(s).
Third Party Data, Information and Intellectual Property:
All data and information that is posted, stored or shared on CC is for non-commercial use only and will be available to all registered users of CC, free of charge.
CC does not guarantee the accuracy, authenticity, and/or ownership of any data, information and/or intellectual property stored on and/or displayed on the Site.
While CC believes such information to be posted in good faith, CC does not control the information provided by others that is made available through the Site. Other user’s information may be inaccurate. You agree to look solely to the Seeker for any claims you may have regarding their information. In the event of a dispute materialising between users of the CC’s Service and/or the Site, you hereby release CC from all liability of any claims howsoever arising out of any such dispute.
You may have the opportunity to communicate with other users. Any information you provide to CC or other users during your registration or use of the Services, in any public message area, through any mail or messaging feature, or otherwise generated out of your use of the Services, is subject to the following:
You are solely responsible for the content of your information, postings, or proposed solutions. CC acts merely as a platform for the distribution and/or publication of that information. CC reserves the right to take any action with respect to such information that it deems necessary or appropriate in its sole discretion if CC believes information is inappropriate for the Site or the Services, may create liability for CC, or may cause CC to lose (in whole or in part) the services of its Internet Service Provider, sponsors, advertisers, or other suppliers. You agree that your information will be accurate and will not, to the best of your knowledge: (a) infringe any third party’s copyright, trademark, patent or other proprietary rights or rights of publicity or privacy, (b) violate any law (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising), or (c) be libelous, unlawfully threatening, or unlawfully harassing.
IV. User Ownership
CC shall retain all ownership in the Site and all content generated by it that is displayed on the Site. CC grants you a nonexclusive, revocable right to use the Site provided that you do not (i) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, (ii) modify or attempt to modify the Site in any manner or form except that you have the right to modify your self-generated content on the Site.
Other Contracts and Confidentiality
You agree that you will not disclose to CC or its affiliates, or to any Seeker, any information which you are under an existing contractual or other legal obligation to maintain in confidence or otherwise do not have the right to sell or license.
Limitation of Liability
CC shall not be liable to you for any damages, claims, expenses or other costs you suffer or incur as a result of third party claims relating to your use of the services. Under no circumstances will CC be liable for any indirect, special, incidental, punitive or consequential damages or for any regardless of the cause.
Any user in contravention of any of the User Guidelines, as contained in Chapter III hereto, shall be in breach of these terms and conditions. CC will be entitled to, at its sole discretion:
- Provide the User with a period of 5 (five) working days to remedy their breach; and/or
- Cancel the User’s account with CC, inclusive of all contributions and/or proposals.
Reservation of Rights
- CC hereby reserves its rights, in full, as set out more fully hereunder:
- Changes to the Website hosting and/or any Services may be made without any prior notice to CC’s visitors and/or members. CC shall incur no liability for any
- CC has full rights of admission in relation to the use of its Website and/or Services, including but not limited to the right to: cancel memberships/accounts, decline requests for membership/accounts, define eligibility criteria and the right to accept, reject and suspend any account or content posted to the Site.
